ANNEX I - Standard information form for package travel contracts
The combination of travel services offered to you is a package tour within the meaning of the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of November 16.
Therefore, you will enjoy all the rights that apply within the EU to package tours. The company Scuba Divine SRL will be fully responsible for the proper execution of the package tour as a whole.
In addition, as required by law, Scuba Divine SRL is covered by a guarantee to refund payments made and, if transport is included in the trip, to ensure your repatriation in the event of insolvency.

Travelers will receive all essential information about the package tour before entering into the package tour contract
There shall always be at least one trader responsible for the proper performance of all travel services included in the contract.
Travelers shall be provided with an emergency telephone number or contact details where they can contact the organizer and, where applicable, the retailer.
Travelers may transfer the package tour to another person, with reasonable notice and, where applicable, subject to the payment of additional costs.
The price of the package tour may only be increased if specific costs (e.g., fuel prices) arise and this is expressly stipulated in the contract, and in no case within the last twenty days prior to the start of the package tour. If the price increase exceeds eight percent of the price of the package tour, the traveler may terminate the contract. If the organizer reserves the right to increase the price, the traveler shall be entitled to a price reduction if the corresponding costs decrease.
Travelers may terminate the contract without paying any penalty and obtain a full refund of all payments made if any of the essential elements of the package tour other than the price are significantly changed. If the organizer of the package tour cancels it before it begins, travelers shall be entitled to a refund of payments made and, where appropriate, compensation.
In exceptional circumstances, for example in the event of serious security problems at the destination that may affect the package, travelers may terminate the contract before the start of the package without paying any penalty.
In addition, travelers may terminate the contract at any time before the start of the package by paying an appropriate and justifiable termination penalty.
If, after the start of the package tour, significant elements of the tour cannot be provided, the traveler must be offered suitable alternatives at no additional cost. Travelers may terminate the contract without paying any penalty in the event of non-performance of the services when this substantially affects the performance of the package tour and the organizer and, where applicable, the retailer fail to resolve the problem.
Travelers shall also be entitled to a price reduction and/or compensation for damages in the event of non-performance or improper performance of the travel services.
The organizer and the retailer shall provide assistance to travelers in the event of difficulties.
If the organizer or retailer becomes insolvent, payments shall be refunded. If the organizer or, where applicable, the retailer becomes insolvent after the start of the package tour and the tour includes transportation, the repatriation of travelers will be guaranteed. Scuba Divine SRL has taken out insolvency protection insurance with MARKEL INSURANCE SE, Branch in Spain. If services are denied due to the insolvency of Scuba Divine SRL, travelers may contact that entity or, where applicable, the competent authority.
